dining concept, along with its business partners (collectively,
"We"), consider the privacy of all participants to be of the utmost
importance. The following discloses our information gathering and
dissemination practices on our web site, as well as through other
means in connection with SocialEats events. The SocialEats concept
and its business is rapidly growing, and as such this privacy policy
may be updated from time to time in order to maintain its accuracy.
As a result, we encourage all participants and other visitors to
our web site to review this privacy policy periodically to keep
up to date.

You acknowledge that you have read our standard
Terms and Conditions pertaining to the use of this web site and
the services provided by us. Those terms and conditions are deemed
to be incorporated herein.
3. OUR PRIVACY POLICY
We are committed to protecting your privacy. We
provide this notice to explain our online and off line information
practices and the choices you can make about the way information
is collected and used. Except as otherwise provided in this Privacy
Policy, at no time will we sell, trade, rent or use your personal
information without your prior written consent. Our web site and
SocialEats events are intended for use and participation by persons
that are over 21 years of age.
4. WHAT PERSONAL INFORMATION DOES SocialEats GATHER?
SocialEats is an events services company created to provide
participants with a way to meet each other, in person, in a social
atmosphere. In order to register participants for SocialEats events,
we collect personal and other information online as part of the
registration process. We also collect personal and other information
from through the submission of information by participants in their
personal My Account folders accessed through our web site. SocialEats
disseminates portions of the information we gather in order to entice
others to attend SocialEats events. The type of information which
you are required or may otherwise choose to provide and how we may
use such information is as follows.
Confidential Information You Give Us: Unless otherwise provided,
we receive and store any information you enter on our web site or
give us in any other way. This includes, without limitation, personal
information you provide online when registering for SocialEats events
and information you enter in your personal My Account folders on our
web site. Examples of such personal information are: (1) your name;
(2) your gender; (3) your age; (4) your email address; (5) city
and zip code of your residence and (6) your telephone number (optional).
We use the information that you provide us to (a) announce upcoming
SocialEats events and/or products, (b) announce upcoming events
and/or products of our business partners, and/or (c) add your name
to the guest list of the SocialEats event that you have made a reservation
for. If you register for a SocialEats event (or attempt registration)
your information is also added to our email mailing list.
Email Address, Nickname and First Name: When participating in a
SocialEats event, we may, in certain circumstances, forward your
email address, nickname and/or first name to any participants attending
the same event. By participating in a SocialEats event you are
giving us permission to provide such information. Except as otherwise
provided in this Privacy Policy, we will not forward your email
address to any other person, whether a participant at the event,
or otherwise, without your prior permission. Please see Terms and
Conditions for a more detailed description of the different types
of matches.
Credit Card Information: When registering for SocialEats events
or purchasing products online, you will be asked for a credit card
number to pay for the events or products. Please read paragraph
10 below concerning the procedures that have been implemented to
secure your privacy in such information that you provide.
Automatic Information: We receive and store certain types of information
whenever you interact with us. For example, like many web sites,
we use "cookies," and we obtain certain types of information
when your web browser accesses www.SocialEats.com. Please see a
more detailed explanation of "cookies" below. A number of companies
offer utilities designed to help you visit web sites anonymously.
Although we will not be able to provide you with a personalized
experience at www.SocialEats.com if we cannot recognize you, we
want you to be aware that these tools exist.
5. COOKIES
Cookies are alphanumeric
identifiers that we transfer to your computer's hard drive through
your web browser to enable our systems to recognize your browser
and to provide features that will help you to enjoy a more personal
and relevant browsing experience.
Cookies are used to auto-log you onto our system, which will allow
you to access settings and personal preferences stored within your
profile. This means that you may login without having to type your
login name each time. Instead, only your password is needed to access
the system.
Most web browsers automatically accept cookies, but if you prefer,

6. DOES SocialEats
SHARE YOUR PERSONAL INFORMATION WITH OTHERS?
Information about
participants is an important part of our business, and we are not
in the business of selling it to others. We share customer information
only as follows:
Business Partners and Sponsors: Our web site and SocialEats events
are run by us together with our business partners. We also offer
businesses the opportunity to sponsor SocialEats events and place
advertising for these businesses on our web site and in our monthly
email newsletter. By registering for a SocialEats event you give
us your permission to provide your name, age, gender and email address
to any of our business partners and/or sponsors. We will use our
best efforts to assure that our business partners and sponsors use
the information provided to them solely for their own business purposes
and do not disseminate this information to any other persons; provided,
however, that we cannot guarantee their compliance with these provisions
SocialEats has no control over the use of your information by any
business partner or sponsor after it has been provided to them.
In the event that you do not want us to provide this personal information
to any additional business partners or sponsors, you must contact
us by email at socialeats@SocialEats.com and request that your information
be removed from our database. After we have removed your information
(which may take up to six weeks from receipt of your request) we
will not provide such information to any further business partners
or sponsors. With respect to the removal of your information from
the databases of any business partners or sponsors to whom we previously
provided your information, you must contact those business partners
or sponsors directly in order to remove such information.
Tell Your Friends: Our participants are given the opportunity to
tell their friends about the SocialEats experience by providing
us, online, with their friends' first names and e-mail addresses.
We will use this information to send an email to these friends with
information on SocialEats. We will not send these friends any follow-up
emails and will not maintain their information in our database,
unless they register with us.
Business Transfers: As we continue to develop our business, we might
sell or buy business assets. In such transactions, client information
generally is one of the transferred business assets. Also, in the
event that SocialEats, or substantially all of its assets are acquired,
information on our participants will of course be one of the transferred
assets.
Certain Necessary or Required Disclosure of Information: In addition
to the other circumstances described herein, we may disclose information
provided by you if required to do so by law, court order, as requested
by other government or law enforcement authority, or in the good
faith belief that disclosure is otherwise necessary or advisable
including, without limitation, to protect our rights or properties
or when we have reason to believe that disclosing the information
is necessary to identify, contact or bring legal action against
someone who may be causing interference with our rights or properties,
whether intentionally or otherwise, or when anyone else could be
harmed by such activities.
With Your Consent: Other than as set out above, you will receive
notice when information about you might go to third parties, and
you will have an opportunity to choose not to share the information.
7. ONLINE and OFF-LINE
SURVEYS
We value opinions
and comments from participants and other visitors to our web site,
and you may have the opportunity to give us your feedback through
online and off-line surveys. In conducting these surveys, we may
ask for your name, address, and/or email address so that we can
appropriately identify you. Survey information collected will be
aggregated and used to make improvements to the site and to improve
our service and general offerings. Participation in the surveys
is completely voluntary and you therefore have a choice whether
or not to disclose this information.
8. IP ADDRESSES
We collect IP addresses
to help collect statistical information about the performance of
our servers and to help our system administrators optimize our server's
performance. These IP addresses will also be used to identify the
most popular sections of our site, which we will then use to help
provide you with a more relevant service.
9. LINKS
Our site contains
links to other web sites. Please note that when you click on one
of these links, you are entering another web site for which neither
SocialEats nor its business partners (unless such link is to one
of its business partners' sites) has any responsibility. We encourage
you to read the privacy statements of all such sites as their policies
may be materially different from our privacy policy. Of course,
you are solely responsible for maintaining the secrecy of your passwords
and any account information.
10. SAFEGUARDS
TO PROTECT THE LOSS, MISUSE OR ALTERATION OF YOUR INFORMATION
We take all reasonable
precautions to protect our users' personal information. When you
submit sensitive information via this site, your information is
protected both on- and off-line and the information resides within
a controlled and secure infrastructure.
We also take all reasonable precautions to protect user information
off-line. Access to all of our users' information is restricted
to our offices, except for the limited information that we may provide
to others, as described in this Privacy Policy. Only employees and/or
contractors who need the information to perform a specific project
are granted access to personally identifiable information.
We use PayPal, a trusted third party to handle all credit card information.
We entrust PayPal to employ powerful Secure Sockets Layer (SSL)
encryption technology or some other trusted technology to encode
sensitive data as it is transferred across the Internet.
11. NOTIFICATION
OF CHANGES
If we decide to
change our privacy policy, we shall endeavor to post notice of a
privacy policy update in the SocialEats email newsletter or on our
web site so that our users may view our updated policy and be aware
on an ongoing basis of what information we collect, how we use it,
and under which circumstances, if any, we disclose it. If at any
point we decide to use personally identifiable information in a
manner different from that stated at the time it was collected,
we shall endeavor to notify registered users by way of email or
by posting on our web site. Users will have the right to approve
the use of their information in any such different manner. We will
not use your information in any way other than in accordance with
the privacy policy under which the information was collected, unless
